LAPA ADOPTION TERMS & CONDITIONS

  1. I (the adopter) intend to adopt the pet identified in my Adoption Agreement (the “Pet”).
  2. I am taking possession of the Pet from LAPA (Helping Animals In Russia) (“LAPA”) on the date identified in my Adoption Agreement (the “Date of Possession”) with the intention to adopt the Pet.
  3. I shall keep the Pet for a period of 1 week, or longer if agreed in writing with LAPA, from the Date of Possession on a trial basis. This time period will be known as the “Trial Period”.
  4. During the Trial Period:
    1. I shall be fully responsible for the Pet and their care. This means that I agree to comply with all relevant laws and regulations concerning welfare, control, responsible ownership and protection of animals including without limitation the Animal Welfare Act 2006 and Codes of Practice issued in England and Wales under that Act . This also means that I will comply with paragraphs 10(b)(c)(d) of this Adoption Agreement.
    2. I will not allow other people outside my household to care for and/or take possession of the Pet without LAPA’s written consent.
    3. I shall keep LAPA fully informed of the Pet’s progress in the form of messages and photo/video materials.
    4. I shall comply with LAPA’s advice and recommendations, if any, in full.
    5. I shall inform LAPA of any issues or problems with the Pet or arising in respect of the Pet without delay. This includes but is not limited to any health and/or behavioural issues/problems and the Pet running away/getting lost or stolen.
    6. (For dog adoption only) I shall walk the Dog on the lead only
    7. (For dog adoption only) I shall ensure that the Dog has a collar with a tag on which provides a contact number in the event the Dog is lost or stolen.
    8. I agree that LAPA has the right to take the Pet back at any time at their own discretion and I will cooperate with LAPA fully in this regard.
    9. Except in the case of an emergency, I will not take the Pet to a vet without a prior written approval from LAPA in respect of the choice of the vet and the scope of veterinary assistance required. The written approval can be provided in the form of an email or a WhatsApp message. I accept that LAPA will communicate with the vet direct.
    10. If the Pet has a health issue arising out of my actions (including but not limited to actions contrary to LAPA’s advice) or the lack of appropriate actions on my part, I shall be liable for the cost of veterinary care to rectify the Pet’s health in full.
  5. No later than on the last day of the Trial Period:
    1. I shall confirm to LAPA in writing (by email or WhatsApp message) whether or not I want to adopt the Pet.
    2. LAPA will confirm to me in writing (by email or WhatsApp message) whether or not they agree for me to adopt the Pet. I will only be able to adopt the Pet if LAPA confirms their agreement for me to do so.
  6. If I do not wish to adopt the Pet and/or LAPA do not agree for me to adopt the Pet, I shall return the Pet to LAPA’s allocated foster home without delay together with all the items that have been lent to me by LAPA for the duration of the Trial Period.
  7. If I do wish to adopt the Pet and LAPA has agreed for me to do so, the ownership of the Pet shall pass to me on the first day after the expiry of the Trial Period, ie on the eighth calendar day from the Date of Possession. This date shall be known as the “Adoption Date”.
  8. Once the ownership of the Pet has passed to me:
    1. I shall return to LAPA without delay all the items that have been lent to me by LAPA for the duration of the Trial Period.
    2. LAPA shall send to me without delay the Pet’s vaccination card.
  9. From the Adoption Date onwards:
    1. I shall be fully responsible for the Pet and their care including veterinary and other costs associated with having the Pet.
    2. I shall comply with all relevant laws and regulations concerning welfare, control, microchip registration, responsible ownership and protection of animals including without limitation the Animal Welfare Act 2006 and Codes of Practice issued in England and Wales under that Act .
    3. I shall
      1. Meet the Pet’s needs which are appropriate to the species, age and health of the Pet. In case of dogs this includes walks of appropriate duration and variety, other forms of mental and physical stimulation including but not limited to play, toys, socialisation, off the lead training.
      2. Groom the Pet including washing and brushing regularly and as appropriate for the species, temperament and coat of the Pet.
      3. Procure vaccinations and anti-parasite treatment for the Pet in accordance with veterinary and/or LAPA’s advice.
      4. Comply with LAPA’s advice on animal care including but not limited to day to day care, training, socialisation, behaviour.
      5. If I have any behavioural and other issues with the Pet or relating to my care for the Pet, report them to LAPA as soon as possible.
      6. Provide LAPA with updates on the Pet including but not limited to photographs and videos at least once a year since the Adoption Date.
    4. I shall not:
      1. Leave the Pet alone in my home for longer than 4 hours.
      2. Leave the Pet unsupervised outside whether in public areas or in my garden and/or on the porch or terrace and/on in communal areas.
      3. Use force, violence or aggression in any form towards the Pet.
      4. Use any behavioural training methods other than positive reward training in respect of the Pet.
      5. Use electronic shock collars, prong collars and the like on the Pet.
    5. I shall not transfer the ownership or possession of the Pet (whether through a sale, a gift or in any other form) to another person without LAPA’s written consent. If I have transferred the ownership or possession of the Pet to another person without LAPA’s consent, I will provide the full contact and other relevant information to LAPA on their request and will make best efforts to assist LAPA to return the Pet back to LAPA at my own cost.
    6. I shall notify LAPA within seven calendar days of any changes to my contact details or any other significant changes in my circumstances (such as moving home, illness, birth/adoption of a child, acquisition of another pet).
  10. The information provided to me by LAPA about the Pet has been provided to me in good faith and to the best of LAPA’s knowledge. This information concerns the pet’s history, health, breed, personality and temperament prior to adoption. LAPA does not guarantee the accuracy of the information provided despite making every effort to ensure that it is accurate.
  11. From the Adoption Date LAPA shall not be liable for any costs relating to the Pet’s health issues or the Pet’s behaviour or any other consequences arising out of the same, regardless of their origin.
  12. If the Pet has not been sterilised prior to the Date of Possession due to the Pet’s age, I shall arrange for the Pet to be sterilised by the date agreed with LAPA in writing (which includes Whatsapp messages and emails) and I will provide a written confirmation to LAPA from a practising vet un the UK that this has been done.
  13. I understand that LAPA provides post-adoption advice and support, within reason and within its capabilities, in relation to the questions concerning the Pet’s behaviour and care. However, I recognise that LAPA’s support and assistance are not a substitute for my primary responsibility for the Pet.
  14. If for whatever reason I struggle with looking after the Pet, I will notify LAPA as soon as possible. I will make reasonable efforts to keep the Pet and resolve whatever issues I may have in relation to the Pet. I will follow LAPA’s recommendations and advice to achieve this. I will update LAPA regularly about my efforts. If despite my efforts I believe I am still unable and/or unwilling to keep the Pet, I will notify LAPA as soon as possible after I reached this conclusion.
  15. The ownership in the Pet shall revert back to LAPA if:
    1. I made false and/or incomplete and/or misleading statements to LAPA in my adoption application form.
    2. I made false and/or incomplete and/or misleading statements to LAPA at any time, whether before or after the Adoption Date, about the Pet’s progress including any aspect of my conduct towards the Pet or circumstances relating to the Pet (including but not limited to how I look after the Pet and the Pet’s wellbeing).
    3. I breached my obligations set out in paragraphs 9, 12 and 14 of this Adoption Agreement.
    4. In LAPA’s sole discretionary opinion based on careful consideration and professional experience, I otherwise mistreated or neglected the Pet.
    5. I decided to return the Pet back to LAPA
  16. In the event paragraph 15 of this Agreement comes into force, the reversion of the ownership in the Pet shall take effect on the date of LAPA Trustees’ decision regarding the same or, in the case of paragraph 15(e) on the date I made my decision to return the Pet to LAPA or the date of LAPA Trustees’ decision regarding the same, whichever is the earliest.
  17. When the ownership of the Pet has reverted back to LAPA in accordance with paragraphs 15 and 16 of this Agreement, LAPA shall have the right of taking immediate possession of the Pet by way of self-help mechanism without requiring a court order and without prior notification to me. I shall cooperate fully in transferring the possession of the Pet to LAPA, if required.
  18. If I have decided to return the Pet back to LAPA and LAPA is unable to take the possession of the Pet from me immediately, I accept that there may be some waiting time before LAPA can take the Pet back. If I wish to surrender the Pet before LAPA can arrange appropriate foster care for the Pet, LAPA will endeavour to make emergency kennel or other boarding arrangements for the Pet, but I will be responsible for payment of all costs associated with that.
  19. If I agreed in my adoption application to make a voluntary donation to LAPA in the suggested amount of £400 for a dog or £180 for a cat, as appropriate, I shall make this donation to LAPA on signing this Agreement.
  20. Should the Pet be returned to LAPA at the end of the Trial Period or before then, LAPA shall return the donation to me in full. Should the Pet be returned after the end of the Trial Period, I accept that I am not entitled to a refund of the adoption donation.
  21. This Agreement is governed by English law and any dispute arising out of or in connection with this Agreement shall be resolved by English courts.
